The Court made the following: ORDER.- The Criminal Petition has beerl filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for brevity f{he Cr.P.C.I)/ Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity [the BNSSJ), seeking to enlarge the petitioners/Accused Nos.1 and 2 on bail in Cr.No.26 of 2025 of Anantapur ll Town Police Station, Anan{hapuram District, registered against the petitioners/Accused Nos.1 and 2 herein for the offences punishable under Sections 318(4), 351 (2) read with 3 (5) of the Bharatiya Nyaya Sanhita, 2023 (for brevity lthe BNS'). 2.

The case of the prosecution is that on 14.02.2025 at about 07.00 P.M., the accused Chintha Madhuravani and her husband chintha --I.-_--.-+ Rama Subba Reddy @ Mannuru Ramanaiah, New Krishna Nagar, Railway Koduru, Kadapa District, lured the complainant P. Roja to invest money for huge profits in import and export business of rice and other edible oil business, and made her believe by showing some documents. ln the faith of good belief and confidence on the accused, the complainant accumulated an amount of Rs.1,15,70,000/-and gave I't tO the accused through`l barlk transfer to M/s Madhu Groups, Bank of ly /I

Even after repeated reminders, the accused did not repay the amount; moreover, the accused threatened the complainant with dire consequences, Stating that if they asked for the money, they would be killed. 3. Heard learned counsel forthe petitioners and the learned Assistant Public Prosecutor. Perused the record. 4. Mr. M.V.S. NikhI-I Kashyap, the learned counsel for the petitioners, contends that the petitioners are innocent of the alleged offence and have been falsely implicated by the police. It is further submitted that the petitioners are the sole earning members of their families and, therefore, their continued incarceration would cause undue hardship to their dependents. The petitioners undertake to strictly adhere to any conditions that may be imposed by this Hon'ble Court. In light of the foregoing, the learned counsel prays that the present petition be allowed in the interest of justice. 5. Per confra, Ms.P.Akhila Naidu, the learned Assistant Public Prosecutor vehemently opposec! the grant of bail to the petitioners, submitting that the investigation is still underway and several material witnesses remain to be examined. lt I'S contended that if the petitioners

4 Dr. YLR, J Crl.P.No.7368 of 2025 Dated 30.07.2025 \_ are released on -bail at this stage, there is a strong likelihood that they may abscond, thereby hampering the ongoing investigation and evading the process of law. ln view of the foregoing, it is urged that the petition be dismissed. 6. On bare perusal of the avermen{s of the FIR lodged by the de-facto complainan't, the de-facto complainant was lured by the petitioner No.1/Accused No.1 to invest huge amounts with the proprietary firm of the petitioners.
The de-facto complainant invested nearly an amount of Rs.1,15,70,000/-under various instalments. lt appears that there is an agreement dated 21.09.2024 (Agreement No. AP27726921576380) in between the petitioner No.1/Accused No.1 and the de-facto complainant for sending some commodities to Qatar and some other places. The de-facto complainant complained that the ±!N|_+1C;++,I-=:>X:a:X:diiu 'y,`rl.-;rr*P petitioner No.1/Accused No.1 provided fake invoice showing shipment of 35 metric tons of palm oil from her group to an oil company in Kadapa. All the family members of the petitioners were shown as accused in this case. Accused No.2 is the husband of Accused No.1. Accused No.1 is the sole propri.etor `of Madhu Groups. 7. Section 5 of the Andhra Pradesh Protection of Depositors of Financial Establishments Act, 1999, was added to the case on
13.04.2025. Later, this Court granted relief to Accused No.4 directing the Investigating Officer to comply with Section 35(5) notice of [the BNS'. The petitioners were arrested on 14.06.2025. The petitioners have been in the judicial custody for the past 46 days. There are no allegations and specific overt acts against the petitioner No.2. Petitioner No.1 is a female. Albeit there is one adverse antecedent against the petitioners v,'de Crime No.236 of 2025 of Railway Kodur Police Station, on the allegation that the petitioners lured gullible unemployed to provide job in Australia, in that case the petitionel-,` Nos.1 and 2 were already enlarged on bail. 8. Considering the age of Accused No.2/petitioner No.2, the petitioner No,1/Accused No.1 being a lady, nature and gravity of the allegations leveled against them, their alleged role played in this case, and the period of detention undergone by the petitioners, {'his Court is I-__-_ inclined to enlarge the petitioners.

The petitioners/Accused Nos.1 and 2 shall be enlarged on bail subject to they executing a personal bond for a sum of Rs.2,00,000/- (Rupees Two Lakhs only), each with two sureties each for the like sum each to the satisfaction of the learned Principal District, and Sessions Judge, Ananthapuram. ii. The petitioners/Accused Nos.1 and 2 shall appear before the Station House Officer, Ananthapur II Town Police Station, Ananthapuramu District, on every Saturday in between 10.-00 am and 05:00 pm, till cognizance is taken by the learned the Trial Court. iii. The petitioners/Accused Nos.1 and 2 shall not leave the limits of the District without prior permission from the station House Officer concerned. iv. The petitioners/Accused Nos.1 and 2 shall not commit or I'ndulge in commission of any offence in future. v. The petitioners/Accused Nos.1 and 2 shall cooperate with the I-nVeStiga{ing Officer in further investI'gatiOn Of the case and shall make themselves available for interrogatI'On by the investI'gating Officer aS and When required.
