1. Applicant in IA No.: CRAN 2 of 2025 in CRA (DB) 132 of 2024 seeks relaxation of condition of bail granted by the Coordinate Bench on February 11, 2025 in CRA (DB) 132 of 2024. 2. The condition of bail of which relaxation is sought for requires the appellant to remain within the jurisdiction of Bidhannagar, Salt Lake, Kolkata excepting for the purpose of attending court proceedings. 3. The learned Advocate appearing for the applicant submits that, the mother of the applicant is aged about 80 years. She is suffering from various ailments. Applicant needs to stay at his original residence in order to look after his mother. 4. NIA authorities are represented. 5. We requested the learned Advocate appearing for the applicant to draw our attention to the medical document showing the ailment that the mother of the applicant is suffering from. 6. Our attention is drawn to Pages 99-100 of the application in this regard. 7. Both those medical documents speak of the mother of the applicant suffering from frozen shoulder. 8.
We are of the view that, the medical condition of the mother of the applicant is not such serious so as to waive the condition of the order granting bail to the applicant as sought for particularly in view of the nature of the
3 incident, gravity of the offence and the involvement of the applicant therein. Apprehension of the NIA that the applicant would indulge in similar activities once he returns to his home cannot be overlooked. 9. Accordingly, the prayer for relaxation/modification of the order granting bail dated February 11, 2025, of the applicant in IA No.: CRAN 2 of 2025 in CRA (DB) 132 of 2024 is rejected. 10. IA No.: CRAN 2 of 2025 in CRA (DB) 132 of 2024 is dismissed. (Debangsu Basak, J.)
