02/10.09.2025 Heard learned counsel for the petitioners and learned counsel for the State.
2. The petitioners are apprehending their arrest in connection with Bandgaon P.S. Case No.09/2025, registered for the offence under Sections 8(b)/18 of N.D.P.S. Act, pending in the Court of the learned Sessions Judge, West Singhbhum at Chaibasa.

Learned counsel for the petitioners submits that the petitioners are villagers and false allegations are made against them of cultivating opium. He submits that the petitioners have got no criminal antecedents, as disclosed in paragraph 8 of this application. He further submits that even the land in question where cultivation has been made, is not belonging to the petitioners. He also submits that petitioner no.2 is the resident of Khunti and he has visited the in-laws house at Bandhgaon in the district of West Singhbhum.

Learned counsel for the State opposed the prayer and submits that the allegations are there of cultivating opium.

Considering that the petitioners have got no criminal antecedents and even the land where cultivation was made, is not belonging to the petitioners and petitioner no.2 is not said to be the resident of Bandgaon, District- West Singhbhum and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioners.

Accordingly, the above-named petitioners are directed to surrender before the learned Court within three weeks from today and in the event of their arrest or surrender, they will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sessions Judge, West Singhbhum at Chaibasa in connection with Bandgaon P.S. Case No.09/2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
