Heard Mr. D. Medhi, learned counsel for the accused petitioner as well as Mr. D.P. Goswami, learned Addl. P.P. appearing for the State respondent. Page No.# 2/3
2. This application under Section 483 of BNSS, 2023 has been filed by the petitioner, namely, Shahid Sabri, seeking regular bail in connection with GHY GRPS Case No. 142/2025, under Section 20(b) (ii) (B) of NDPS Act. The accused was stated to be arrested on 09.09.2025 and since then, he was in judicial custody. 3. The FIR dated 10.09.2025 lodged by the Inspector of Police, GRP of Kamakhya Railway Station. The petitioner was stated to be travelling and he came to Kamakhya Junction to go to Delhi by train. Upon search was found in possession of 5.983 Kgs, of suspected cannabis (Ganja). It is submitted by the learned counsel after inventory process, the weight was 5.708 Kgs. Investigation has progressed but stated to be pending for FSL report. 4. The accused is stated to be from outside the State and the investigation has lends support to the allegation about the recovery of narcotic drugs. 5. It is submitted by the prosecution the seizure witnesses have also supported the seizure of the alleged contraband. 6. Considering the progress of the investigation and the length of detention, despite the adverse materials, the accused petitioner is hereby allowed to go on bail of Rs. 50,000/- with two sureties of like amount each, one of whom should be from the State of Assam, to the satisfaction of the concerned learned Court, and subject to the following conditions that:- (i) He shall not abscond, (ii) He shall not hamper or tamper with the evidence. (iii) He shall not indulge in any illegal activities, including activities prohibited by the NDPS Act. Page No.# 3/3
7. Violation of bail conditions will entail cancellation of the bail. 8. This bail application stands allowed and disposed of. 9.
