SODUM ANVESHA The Court made the following: 2 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the inaction on the part of the respondents in respect of providing necessary protection to the petitioners life, properties and lives of his family members in the hands of the respondents 5 and 6 herein whenever the petitioner visit his native place Rukavaripalle via Kadapa Town in order to see his aged mother and to look after his properties situated in the petitioners native place and in not receiving the petitioner representation dated 24-11-2020 about such threats in the hands of the respondents 5 and 6 herein as illegal, arbitrary, malafide and against the principles of Natural Justice besides violation of constitutional guarantees as provided under the Constitution of India and to consequently direct the respondents to provide necessary protection to the life and properties of the petitioner and lives of his family members in the hands of the respondents 5 and 6 herein, in the interest of justice.” 2. Sri Md.Farooq, learned Assistant Government Pleader for Home, on written instructions would submit that, based on the complaint given by the Petitioner, a case in Crime No.158 of 2019 for the ofefnces under Sections 420 and 506 IPC on the file of Chennuru Police Station was registered and after investigation the Police referred the same as “civil in nature”. Subsequently, based on the complaint of one Palampalli Ramulamma of Rukavaripalli Village, Kadapa, a case in Crime No.6/2020 for the offences under Sections 323 and 509 read with 34 IPC was glistered against the Petitioner and the same was referred as “lack of evidence”. Learned Assistant Government Pleader would submit that there is no specific life threat to the Petitioner from any corner. The matter is civil in nature and the Police cannot interfere in the civil issues unless there is a direction from the Court. 3. Sri K.Jyothi Prasad, learned counsel for the Petitioner would submit that the Court may pass appropriate orders. 3 4. Considering the submissions made, the Writ Petition is disposed of giving liberty to the Petitioner to work out his remedies before appropriate forum in accordance with law. There shall be no order as to costs.
