Counsel for Applicant :- Ritesh Tiwari,Surendra Mohan Mishra Counsel for Opposite Party :- G.A. Hon'ble Samit Gopal,J. 1. List revised. 2. Heard Sri Surendra Mohan Mishra, learned counsel for the applicants, Sri Birendra Pratap Singh, learned counsel for the State and perused the material on record. 3. This bail application under Section 483 B.N.S.S has been filed by the applicants-Vikky and Harendra, seeking enlargement on bail during trial in connection with Case Crime No.1071 of 2023, under Sections 147, 323, 504, 506, 325, 452, 336, 304, 34 IPC, Police Station Kotwali Padurana, District Kushinagar. 4. Learned counsel for the State submits that he has received instructions in the matter for which he had prayed time on 5.3.2025. 5. The FIR of the matter was lodged on 10.11.2023 against eight persons including the applicants alleging therein that they have assaulted the family members of the informant on 29.10.2023 at about 5 p.m. who have received injuries. The FIR be thus lodged and action be taken. 6. Learned counsel for the applicant argued that the applicant has been falsely implicated in the present case. It is argued that from the side of the applicant seven persons have received injuries but the injuries were although found to be simple in nature but the fact that they have received injuries goes to show that there are cross versions. The FIR from the side of the applicant was lodged by Vikky Chauhan against 11 persons as a cross case which was registered as Case Crime No.1034 of 2023 under Sections 147, 323, 452, 325, 308, 427 IPC, Police Station Kotwali Padrauna, district Kushi Nagar. Co-accused Satya Narayan and Bhikham have been granted bail by coordinate Bench of this Court vide order dated 11.11.2024 passed in Criminal Misc. Bail Application No.37035 of 2024, copy of the same is annexed as Annexure No.9 to the affidavit filed in support of bail application. The said order reads as under:- "1. List has been revised. 2. Heard Sri Surendra Mohan Mishra, learned counsel for the applicants, Sri V.K.S. Parmar, learned A.G.A. for the State and perused the record. 3. Applicants seek bail in Case Crime No.1071 of 2023, under Sections 147, 323, 504, 506, 325, 452, 336, 304/34 I.P.C., Police Station Kotwali Padurana, District Kushinagar, during the pendency of trial. PROSECUTION STORY: 4. The applicants along with six other named accused persons are stated to have assaulted the family members of the informant on 29.10.2023 at about 5:00 p.m. and caused grievous injuries to them. ARGUMENTS ON BEHALF OF APPLICANTS: 5. The applicants are absolutely innocent and have been falsely implicated in the present case. 6. From the side of the informant, seven persons had sustained injuries and the injures were found to be simple in nature. No injury was observed in the abdomen of the deceased person but he was admitted again at the hospital several times and he expired after a period of more than two months at the hospital. 7. As per post-mortem report, the cause of death was septicemia as a result of ante-mortem injuries. 8. Initially the FIR was instituted under Sections 147, 323, 504, 506, 325, 452, 336 I.P.C. only, but subsequently after the death of one of the injured persons, the case has been transformed to that of under Section 304 I.P.C. 9. The FIR is delayed by about twelve days and there is no explanation of the said delay caused. 10. There is a cross-version to the instant case as FIR No.1034 of 2023 was instituted from the side of the applicants two days after the incident at 7:48 p.m. 11. There are three injured persons who had sustained injuries from the side of the applicants, as such, at this point of time, it cannot be ascertained as to which party was the aggressor one. 12. Several other submissions have been made on behalf of the applicants to demonstrate the falsity of the allegations made against them. The circumstances which, as per counsel, led to the false implication of the applicants have also been touched upon at length. 13. There is no criminal history of the applicants. The applicants are languishing in jail since 10.09.2024 and are ready to cooperate with trial. In case, the applicants are released on bail, they will not misuse the liberty of bail. ARGUMENTS ON BEHALF OF STATE BY A.G.A.: 14. The bail application has been opposed but the submissions raised by the learned counsel for the applicants could not be disputed. CONCLUSION: 15. The well-known principle of "Presumption of Innocence Unless Proven Guilty," gives rise to the concept of bail as a rule and imprisonment as an exception. 16. A person's right to life and liberty, guaranteed by Article 21 of the Indian Constitution, cannot be taken away simply because the person is accused of committing an offence until the guilt is established beyond a reasonable doubt. Article 21 of the Indian Constitution states that no one's life or personal liberty may be taken away unless the procedure established by law is followed, and the procedure must be just and reasonable. The said principle has been recapitulated by the Supreme Court in Satender Kumar Antil vs. Central Bureau of Investigation and Ors., 2022 INSC 690. 17. Reiterating the aforesaid view the Supreme Court in the case of Manish Sisodia vs. Directorate of Enforcement, 2024 INSC 595 has again emphasised that the very well-settled principle of law that bail is not to be withheld as a punishment is not to be forgotten. It is high time that the Courts should recognize the principle that "bail is a rule and jail is an exception". 18. Learned A.G.A. could not bring forth any exceptional circumstances which would warrant denial of bail to the applicant. 19. It is settled principle of law that the object of bail is to secure the attendance of the accused at the trial. No material particulars or circumstances suggestive of the applicant fleeing from justice or thwarting the course of justice or creating other troubles in the shape of repeating offences or intimidating witnesses and the like have been shown by learned A.G.A. 20. Considering the facts and circumstances of the case, submissions made by learned counsel for the parties, the evidence on record, and without expressing any opinion on the merits of the case, the Court is of the view that the applicants have made out a case for bail. The bail application is allowed. 15. Let the applicants-Satya Narayan and Bhikham involved in aforementioned case crime number be released on bail on furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned subject to following conditions. (i) The applicants shall not tamper with evidence. (ii) The applicants shall remain present, in person, before the Trial Court on dates fixed for (1) opening of the case, (2) framing of charge and (3) recording of statement under Section 313 Cr.P.C. If in the opinion of the Trial Court absence of the applicants is deliberate or without sufficient cause, then it shall be open for the Trial Court to treat such default as abuse of liberty of bail and proceed against them in accordance with law. 21. In case of breach of any of the above conditions, it shall be a ground for cancellation of bail. Identity, status and residence proof of the applicants and sureties be verified by the court concerned before the bonds are accepted. 22. It is made clear that observations made in granting bail to the applicants shall not in any way affect the learned trial Judge in forming his independent opinion based on the testimony of the witnesses. " 7. Learned counsel for the applicant further submits that co- accused Rudal alias Ramnaresh Chauhan has been granted bail by coordinate Bench of this Court vide order dated 12.12.2024 passed in Criminal Misc. Bail Application No.45604 of 2024, copy of the same is annexed as Annexure No.9 to the affidavit filed in support of bail application.
