2.
Learned counsel for the petitioner submits that accused- petitioner has falsely been implicated in this case. He submits that impugned FIR has been lodged against the petitioner on the basis of false allegations. It is submitted that petitioner and complainant are relatives. It is contended that there are no criminal antecedents against the petitioner and trial will take considerable time in its conclusion. Counsel submits that petitioner is in custody since his date of arrest and further custody of the petitioner would not serve any fruitful purpose.
3. Learned Public Prosecutor opposes the submissions made by
learned counsel for the petitioner and submits that there is serious allegation against the petitioner of demanding ransom. He further submits that Investigation is still going on.
4. Having regard to the totality of the facts and circumstances of the case, considering the arguments advanced at bar, especially considering the fact that serious allegation has been levelled against the petitioner and Investigation is going on as well as looking to the nature and gravity of offence, this court is not inclined to enlarge the petitioner on bail.
5. Accordingly, this bail application stands dismissed.
6. The observations made hereinabove are only for disposal of the instant bail application and would not prejudice the trial in any manner.
