Learned counsel Mr. A. Mannaf is present for the petitioner Azad Uddin Laskar @ Ajad Hussain Laskar, who has filed this application under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 read with Article 227 of the Constitution of India for quashing the impugned order dated 22.10.2025 passed by the learned Sub-Divisional Judicial Magistrate (S), Cachar, Silchar, whereby the Court has issued Bailable Warrant of Arrest in P.R. Case No. 1316/2025 arising out of Silchar Police Station Case No. 258/2025 under Section 75(1) (ii)/78(1)(i)/79 of Bharatiya Nyaya Sanhita, 2023.
2. Heard learned Additional Public Prosecutor Mr. B. Sarma, who has accepted notice on behalf of respondent No. 1.
3. It is submitted on behalf of the petitioner that the petitioner is willing to cooperate with the trial. It is submitted that a false case has been initiated against the petitioner but even then, the petitioner is willing to cooperate with the trial. Unfortunately, warrant has been issued against him.
4. I have considered the submissions that the petitioner is willing to cooperate with the trial and therefore, without issuance of notice on respondent No. 2, this Court deems it appropriate to direct the petitioner to appear before the Court and cooperate with the trial. A pragmatic view is also taken and
Page No.# 3/3 therefore, the petitioner is directed to appear before the jurisdictional Court/Eleka Magistrate on or before 18.12.2025 and cooperate with the trial.
5. Till then, the BWA issued against the petitioner is kept in abeyance. No coercive action to be taken against the petitioner till then.
6. In view of the above observation, this petition stands disposed of.
