He further submits that an application under Order IX Rule 13 was filed for recalling the ex-parte decree but the said application was dismissed for want of prosecution. Thereafter, a restoration application was filed which has also been dismissed. Looking to the facts of the case, as the decree has already been executed, the writ petition has become infructuous.
