The present application under Section 528 of Bharatiya Nagarik Suraksha Sanhita has been filed to quash the entire proceedings of Criminal Case No.1381 of 2020 (Sessions Trial No.841 of 2020), arising out of Case Crime No. 30 of 2020, under Sections 304, 34 I.P.C., P.S. Paikoliya, District Basti as well as cognizance order dated 19.05.2020, pending in the court of Sessions Judge, Basti, on the basis of compromise. After some argument, learned counsel for the applicants submits that the present application under Section 528 BNSS may be dismissed as not pressed with liberty to the applicants to file appropriate application/proceeding before the court concerned. In view of the statement of learned counsel for the applicants, the present application 528 BNSS is dismissed as not pressed with liberty to the applicants to file appropriate application/proceeding before the court concerned.
