By means of this petition filed under Article 226 of the Constitution, the petitioner has prayed for following relief as substantial relief: "i) Issue a writ, order or direction in the nature of mandamus directing the respondents to provide appointment to the petitioner on any suitable post in the respondent department on compassionate basis under Dying in Harness rules being real brother of deceased employee, who died in harness." It is contended on behalf of the petitioner that petitioner has already moved application in the above regard before the respondent no. 2 on 22.01.2025 which is still pending consideration. Learned Standing Counsel submits that the wife of deceased namely Smt. Anjali and therefore, she may also be heard in the matter before final order is passed. He submits that he has no objection in the event this petition stands disposed of with a direction to the respondent no. 2 to look into and consider the grievance of the petitioner and pass appropriate order strictly in accordance with law. In view of the above, this petition stands disposed of with a direction that respondent no. 2 shall consider the grievance of the petitioner raised in his representation and decide the same after giving opportunity of hearing to the petitioner as well as widow Smt. Anjali as expeditiously as possible preferably within a period of two months from the date of receipt of certified copy of this order. Needless to add the order to be passed by the competent authority, as directed herein above, shall be reasoned and speaking one.
