1.PUBLIC PROSECUTOR The Court made the following: ORDER: This Criminal Petition under Section 482 of BNSS, is filed seeking to grant anticipatory bail to the petitioner herein/accused No.42 pertaining to Crime No.59 of 2024 of Karempudi Police Station, registered for the offence punishable under Sections 143,147, 307, 332, 435 and 427 read with 149 of IPC:,#*
2. Heard Sri Yarramsetty Venkatesh, learned counsel for the petitioner on record and Sri K.Sandeep, learned Assistant Public Prosecutor for the Respondent-State. 3. The present petitioner is Sri Bommina Venkateswarlu. He is Accused No.42 as per the petition. 4. On hearing the learned counsel on both sides and on perusal of the record, it is seen that FIR in this case was registered on 15.05.2024 against several accused, including this petitioner.
The petitioner/A42 and other accused earlier filed Criminal Petition No.4101 of 2024 seeking anticipatory bail, and by Order dated ll.07.2024, this Court granted the prayer for all the accused except the present petitioner. ln paragraph No.7 of the order, the reason for refusal of the prayer was mentioned, stating that from the record made available, this petitioner was the one who poured petrol on the victimls car and lit fire to it. 5. The submission of learned counsel for the petitioner is that the eyewitnesses to the incident, as well as the person whose car suffered damage, gave their statements before the investigating officer. These statements were duly recorded in writing and they are LW-15 and LW-16. As per their statements, the allegations against the present petitioner/A42, is limited to his bearing part of a group along with his colleagues. Further, the statements of these witnesses indicate that the car went a distance of about 100 yards, and someone poured petrol and set it on fire there. There has been progress in the investigation, the changes in circumstances indicate that the act of setting the car on fire is not solely attributable to the petitioner. ln the light of these circumstances, this Court finds that there is justification in granting the relief-;giv --``
6. ln view of the aforesaid facts and circumstances, this court is inclined to grant anticipatory bail to the petitioner herein/A42. 7. ln the result, the criminal petition is allowed with the following conditions: i) The petitioner is directed to join the investigation. ii) ln the event of his arrest, the petitioner/A42 shall be enlarged on bail on his executing a personal bond for a sum of Rs.25,000/-(Rupees Twenty Five Thousand only) with two sureties of the lI'ke Sum each tO the satisfaction of the I-nvestigating officer. iii) After release, the petitioner shall appear before the StatI®On House Officer concerned, on every Sunday between 10.00am to 01.00pm for a period of three (3) months.
iv) The petitioner shall make himself available for investigation by a police officer as and when required, and he shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade her from disclosing such facts to the Court or to any police officer.
