Laskar, learned counsel for the petitioner and also heard Mr. S.M.T. Chistie, learned standing counsel for the respondents, in Secondary Education Department. This petition under Article 226 of the Constitution of India is preferred by the petitioner for issuing direction to the respondent authorities for refunding a sum of Rs.39,500/-, which the petitioner has deposited with the respondent No.5 herein for admission of the petitioner as the school fees and also the hostel fees. The learned counsel for the petitioner submits that this petition was filed 10 days back and in the meantime, the respondent No.5 has already refund the amount of Rs.39,500/- in the account of the petitioner and that being so, nothing left to be decided in this petition and accordingly, the same stands closed.
