ORDER 28.11.2025 Heard Mr. M. Khan, learned counsel for the petitioners. Also heard Mr. D. P. Goswami, learned Addl. P.P., Assam appearing for the State. This is an application under Section 482 of the BNSS, 2023 for grant of pre-arrest bail to the accused/petitioners, viz., 1) Ayub Ali, 2) Kobir Ali @ Ashraful Islam, 3) Nabir Ali, 4) Bosor Ali, 5) Hasen Ali @ Hachen Ali, 6) Ahidul Islam @ Ahidul Hoque and 7) Mamud Ali in connection with Manikpur P.S. Case No.116/2025 registered under Sections 61(2)/126(2)/127(2)/109(1)/117(2)/118(2) of the BNS, 2023. Page No.# 3/4 The allegation as reflected in the F.I.R. dated 07.11.2025 lodged by one Ahad Ali is that while he was walking on 20.09.2025 at about 8:30 a.m. the accused persons with the instruction of accused/petitioner No.1 and 4 took him in his house and assaulted him causing fracture on his left leg through rod and tried to kill him by pouring petrol on his body causing grievous injury and thereafter he was saved by neighbours. It is submitted on behalf of the petitioners that the petitioners’ side have been assaulted by the persons of the informant side on 20.09.2025 and the petitioners had gone and lodged an F.I.R. at the Police Station on 21.09.2025 but no case was registered. Subsequently, on 07.11.2025 they lodged a complaint case against the informant side and on the same day the present F.I.R. was lodged at 9.30 P.M. by the informant against the petitioners. It is submitted that from the above it is evident that the present case of the informant is an afterthought more so in view of the fact that the said F.I.R. has been lodged more than a month after the alleged date of occurrence. The learned Additional Public Prosecutor with reference to the Case Diary including the medical report submits that the allegations made in the F.I.R. are fully supported by the Case Diary. The medical report indicates fracture of the leg and burn injuries over different parts of the body and the statements of the witnesses also clearly implicate the petitioners except petitioner No.1, Ayub Ali and petitioner No.6, Ahidul
