Page No.# 2/3 Suraksha Sanhita, 2023, praying for granting of pre-arrest bail in respect of the accused/petitioner namely Md. Nobi Hussain @ Nobi Hussain in connection with G.R. Case No. 1082/2025, under Section 379/411/413 of the Indian Penal Code in connection with P.R.C. Case No. 1703/2023 arising out of North Lakhimpur P.S. Case No. 519/2022 pending before the learned Chief Judicial Magistrate, Lakhimpur, North Lakhimpur, Assam. 3. Charge-sheet has already been submitted in the instant case showing the present petitioner as absconder. 4. On perusal of the Charge-sheet, it appears that the only allegation against the petitioner is that an injured cow was recovered from his premises. The main allegation as per the Charge-sheet is regarding theft of cattle of the informant by an unknown persons, but subsequently, the cows were recovered and handed over to the informant as reflected in the Charge-sheet. As regards the cow said to have been recovered from the premises of the petitioner, there is no mention in the Charge-sheet that the said cow was a stolen one. 5. It is submitted by the learned counsel for the petitioner that the said cow belonged to the petitioner himself. 6. Having regard to the above, it is provided that the petitioner in the event of his arrest or upon his appearance before the learned Trial Court below/Magistrate, shall be released on bail of Rs. 20,000/- with two sureties of like amount to the satisfaction of the concerned Court/Authority in connection with the aforesaid case. 7. It is further provided that the petitioner shall face the Trial, if any and shall not try to influence the witnesses in any manner. Page No.# 3/3
