2. This application under Section 482 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 filed by the petitioner, namely Ajahar Ali @ Ajaharul Ali, apprehending arrest in connection with North Lakhimpur P.S. Case No. 323/2025 registered under Section 140(3) of BNS, 2023.

3. The allegation against the petitioner is that he had taken away the minor daughter of the complainant on 18.09.2025, at around 8 p.m. and after search was conducted, the parents of the accused handed her over at 3 a.m. on the same night.
4. The scanned copy of the TCR alongwith the Case diary has been received.
5. Having regard to the fact that the investigation is over and also having regard to the nature of the allegation, the custodial detention of the petitioner is deemed to be not necessary,
6. Accordingly, the prayer for pre-arrest bail is allowed. The interim order dated 31.10.2025 is hereby made absolute subject to the conditions mentioned in the said interim order at serial No. (2) and (3).
7. It is further provided that in case during the course of trial, the petitioner shall appear before the trial court regularly and shall not try to influence or intimidate others.
