Applicants-Mintu Beldar and Ashish Beldar have filed this petition under Section 447 Bhartiya Nagrik Suraksha Sanhita, 2023 for transfer of Sessions Trial No. 443 of 2015; titled State vs. Mintu Beldar and another, arising out of Case Crime No. 79 of 2015, under Sections 302, 201 I.P.C., registered at Police Station Khajni, District Gorakhpur pending before District and Sessions Judge, Gorakhpur to any other court of competent jurisdiction in other district. As per avernments in the application itself, the final arguments were addressed before the trial court and the case was reserved for judgment, and later, according to the accused persons, the complainant proclaimed that the accused would be convicted. The ground raised in the application is not supported by any material, therefore, no ground is made out for transfer of the subject case. Resultantly, the application fails and is hereby dismissed.
