JUSTICE SANJEEV KUMAR SHARMA ORDER Date : 01.12.2025 1. Heard Md. I Hussain, learned counsel for the petitioner. Also heard Mr. R.J Baruah, learned Addl. Public Prosecutor for the State of Assam. 2. This is an application u/s 483 of the BNSS, 2023 for grant of regular bail to the petitioner namely, Sri. Dipankar Mahanta, who was arrested on 08.10.2025 upon surrender in connection with Tingkhang P.S Case No. Page No.# 2/2 82/2025 corresponding to G.R No. 1037/2025 u/s 108 of the BNS, 2023. 3. As per the allegations reflected in the FIR, the deceased, who was the wife of the informant, was in an illicit relationship with the present petitioner and on 03.10.2025, the deceased died by suicide. 4. Although from the material available on record, it appears that the deceased was in an illicit relationship with the present petitioner and there is no such material indicating any active abetment on the part of the petitioner who voluntarily surrendered before the police and has by now spent 54 days behind bars. 5. Considering the above, the prayer for bail is allowed. 6. As such, the above named petitioner is allowed to be released on bail of Rs. 20,000/- with 1(one) surety of like amount to the satisfaction of the concerned Ld. Trial Court. 7. It is further provided that the petitioner : (i) shall not abscond. (ii) shall be available for trial. (iii) shall not hamper tamper the investigation or with the evidence. (iv) shall not misuse his liberty to commit any illegal acts or offences. 8. Bail application stands disposed of. JUDGE Comparing Assistant
