The Court made the following ORDER: The present Writ Petition came to be filed under Article 226 of the Constitution of India seeking the following relief:-
“…to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the respondents in non-payment an amount of Rs. 13,60,420/- in total due even after finalizing the bills, payable to the petitioner after the successful completion of the execution of works i.e 1. Desilting of Nelatur Tank supply channel in Muthukur Mandal of SPSR Nellore District vide Agreement No. 162 O and DN/2020-21 dated 14.10.2020 2. Desilting of leading channel of Pantapalem Tank in Muthukur Mandal, SPSR
Nellore District vide Agreement 163/0 and M/DN/2020-21 dated 14.10.2020 duly approved by the respondents, as illegal, arbitrary, unjust, unreasonable and violative of fundamental rights guaranteed to the Petitioner under Articles 14 and 21 of the Constitution of India and consequently direct the respondents to release an amount of Rs. 13,60,420/- towards the works executed by the petitioner along with 12 percent interest per annum and to pass such….”

The petitioner was entrusted with the works of execution of desilting of Nelatur Tank supply channel in Muthukur Mandal of SPSR Nellore District, as well as desilting of the leading channel of Pantapalem Tank in Muthukur Mandal of SPSR Nellore District, vide agreement dated 14.10.2020, for a sum of Rs.13,60,420/-. 3.
The grievance of the petitioner in the present writ petition is that, he has completed the works as per the said agreements, and after verification, the respondents have also issued quality control certificates on 02.12.2020,

admitting the said amounts payable to the petitioner, but in spite of the same the respondents have failed to make the said payments. 4. Heard learned counsel for the petitioner, learned Assistant Government Pleader for Irrigation, and learned Assistant Government Pleader for Finance and Planning. 5. As the petitioner has filed the quality control certificate to a sum of Rs.13,16,420/- as claimed by him, which was admitted by the respondents, instead of keeping this writ petition pending, this Court feels it appropriate to dispose of the writ petition by directing Respondent No.4 to make such payments as expeditiously as possible, preferably within a period of eight (8) weeks from the date of receipt of a copy of this order. 6. With the above observations, this writ petition is disposed of. There shall be no order as to costs.
