ORAL ORDER
1. This writ petition is by the purchaser.
2. The land in question was granted in the year 1950 and a saguvali chit was issued on 05.09.1950.
3. The prescribed period of non-alienation was 20 years. However, after the Act came into force, the grantee sold the property on 12.09.1984 to the 7th respondent and the 7th respondent thereafter sold the property to the present petitioner on 28.11.2006.
4. Thereafter in the year 2007, the legal representatives the original grantee have initiated proceedings for resumption and this has been accepted by the Assistant Commissioner and confirmed by the Deputy

Commissioner. As a consequence, the petitioner is before this Court.
5. A Division Bench of this Court in Smt.M.Manjula’s case1, while considering a case in relation to an alienation made after the Act came into force has come to the conclusion that the application for resumption would have to be made within a reasonable period and it is also stated that any application made beyond 12 years would be unreasonable and the principle of latches would come into operation.
6. In this case, the land was granted in the year 1950, the first alienation was made in the year 1984 and the application for resumption was made after nearly 22 years thereafter in the year 2006. Therefore, the ratio laid down by the Division Bench in Smt.M.Manjula’s case, in W.A.No.210/2023 will squarely apply.

7. Consequently, the impugned proceedings are quashed and this writ petition is allowed.
8. In view of the disposal of the petition, all pending interlocutory applications, if any, stand disposed of.
