1. Order of eviction has been passed by Respondent no. 2/Assistant Collector/Tehsildsar (Judicial), Tehsil Nagina, District Bijnor. Apart from the same damages to the tune of Rs. 19,440/- was also imposed. Aggrieved against the aforesaid a statutory appeal was filed by the petitioner which was allowed by the Collector, Bijnor vide order dated 18.08.2018. By the aforesaid
order the order dated 30.12.2017 was set aside and the matter was remitted back to the respondent no. 2 to pass a fresh order.
2. It is argued that though a considerable time has already been lapsed but till date no final decision has been taken in the matter. Hence the present petition. it is further argued that though the
order dated 30.12.2017 was set aside but without considering the aforesaid aspect of the matter the respondents are trying to evict the petitioner from the plot in dispute.
3. Heard counsel for the petitioner, learned Standing Counsel on behalf of respondent nos. 1 and 2, Sri Arun Kumar Pandey, learned counsel for respondent no. 3 and perused the record.
4. In the facts and circumstances of the case, the present petition is
disposed of directing the respondent no. 2 to decide the matter strictly in accordance with law and in view of the
observations made by the Collector, Bijnor in its judgment and
order dated 18.08.2018 most expeditiously and preferably within a period of six months from the date of production of certified copy before the Court below but without granting unnecessary adjournment unless there is no legal impediment.
5. Till the disposal of the case, no coercive action shall be taken against the petitioner.
