Ms. Sampoorna Saha, Adv. …for respondent no.4 The Court: The petitioner has preferred the present petition under Section 9 of the Arbitration and Conciliation Act, 1996, seeking interim measure, inter alia, restraining the respondent nos.2 and 3 from withdrawing or operating any amount from the bank accounts of the respondent no.1, particularly the bank account numbers mentioned in 2 prayer (a) of the present petition along with other consequential reliefs, as prayed for in the prayer clause. Learned Counsel for the petitioner in the outset itself states that respondent no.4 shall be deleted from the array of parties. Accordingly, the respondent no.4 is deleted from the array of parties. After arguing the matter for some time, learned Counsel for the petitioner states that he does not wish to press the present petition and the parties mutually agree to the appointment of Hon’ble Justice Sanjib Banerjee (Retired) as learned Arbitrator to adjudicate the dispute between the parties. In view thereof, with the consent of the parties, Hon’ble Justice Sanjib Banerjee (Retired) is appointed as the Sole Arbitrator to adjudicate the disputes between the parties. Parties are at liberty to move appropriate applications in accordance with law before the learned Arbitrator. The learned Arbitrator shall decide his remuneration in accordance with law.
