The instant petition under Section 528 of the BNSS has been filed by the Petitioner/Accused No.1, seeking to quash the proceedings against him in Crime No.52 of 2025 on the file of Macherla Town Police Station, Palnadu District, registered for the offence under Section 125(a) of BNS. 2.
When the matter is taken up for hearing, learned counsel for the petitioner would submit that the petition may be disposed of without causing any prejudice to the rights and contentions of the petitioner and liberty may be given to file fresh petition after filing of the charge sheet. 3. Learned Assistant Public Prosecutor would submit that the Court may pass appropriate orders. 4. In that view, the criminal petition is disposed of, without causing any prejudice to the rights and contentions of the petitioner. However, the petitioner is at liberty to file fresh petition after filing charge sheet, if so advised.
