GP MUNCIPAL ADMN AND URBAN DEV AP 2 The Court made the following Order: The petitioner is aggrieved by the action of respondents in constructing pipeline on the private path which was used for ingress and egress by the residents. 2. It is submitted that the residents of that line had get a portion of private property to be used as path. It is submitted that the 2nd respondent without initiating any acquisition proceedings has constructed a pipeline. It is further submitted that the petitioner has acquired title over the same by virtue of Lok Adalat Award passed in O.S.No.329 of 1999. In this regard a representation was submitted to the 2nd respondent which was not considered. 3. Learned Standing Counsel appearing for the 2nd respondent submits that the property was initially a private path. However, the municipal authorities have laid a CC road and also have been maintained the same. It is submitted that once the road is laid and electric lines are laid over the same, the property will hand over to the Municipality. It is submitted that the pipeline for supply of water was laid for ensuring supply of water drinking pipeline. It is also submitted that the full survey also indicates that 14 feet road is there which is used by the residents. Attention of the Court is drawn to the schedule of property pertaining to the petitioner in O.S.No.329 of 1999 whereby the northern side boundary is shown as 14 feet wide road. 4. It is submitted by the learned Standing Counsel for the 2nd respondent that the work is completed. 3 5. Recording the submissions that the road is unaffected in spite of laying of the pipeline for the purpose of supply of drinking water, no further orders are required. 6. Accordingly, the Writ Petition is closed. No costs.
