24.11.2025 Heard Mr. T.J. Mahanta, learned counsel for the petitioner. Also heard Mr. D.P. Goswami, learned Additional Public Prosecutor for the State. This application is filed under Section 483 of the BNSS, 2023 praying for bail to the petitioner who was arrested on 13.11.2025 in connection with Barpeta Road Police Station Case No. 122/2025
Page No.# 2/2 registered under Section 196(1)/152/352/353(2) of the Bharatiya Nyaya Sanhita, 2023. It appears that the only allegation against the petitioner is that he made a certain comment i.e.
“Election r time t eibur hot thake” which was published in social media by Assamese News Channel and that apparently the comment was in relation to the recent Bomb Blast that took place in Delhi. In the meantime, the petitioner has already spent 11 days in custody. Having regard to the nature of the allegation, further detention of the petitioner is not considered necessary. Accordingly, the prayer for bail is allowed. The petitioner shall be released on bail with a bail bond of Rs. 50,000/-(Rupees fifty thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Barpeta, Assam.
