This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioners apprehending their arrest in connection with Jharia P.S. Case No.176 of 2024, for offences under Sections 127(1), 329(4), 115(2), 117(2), 109, 74, 352 and 3(5) of the Bharatiya Nyaya Sanhita, 2023. The case is presently pending before the Court of learned A.C.J.M. Dhanbad.

Heard learned counsel for the petitioners and learned counsel for the opposite party – State.

There is a direct allegation against the petitioners that they have assaulted the son of the informant, who sustained head injury.

Learned counsel representing the petitioners submits that there is a case and counter case and both the parties assaulted each other. He further submits that petitioner No.1 is aged about 80 years.

Considering the allegation of assault, I am not inclined to enlarge these petitioners on anticipatory bail.

Accordingly, this Anticipatory Bail Application is dismissed.

However, if the petitioners appear before the learned Court below, their cases will be considered as per their own merit, specially in respect of petitioner No.1, who accordingly to the petitioner is aged about 80 years.
