02/ 10.09.2025: Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Namkum P.S. Case No. 191/2020, registered under sections 467, 468, 420, 473, 474, 272, 273, 120B, 34 of the I.P.C and under sections 47(a), 47(f), 52 D and 55 of the Excise Act, pending in the Court of learned Judicial Magistrate, IX, Ranchi.

Learned counsel for the petitioner submits that petitioner was posted in Army and he has retired from the post of Hawaldar. He submits that the vehicle in question was sold by the brother of the petitioner to one Md. Mahatab Alam and said Md. Mahtab Alam sold the said vehicle to one Abhinash Kumar. He submits that allegations are made that illicit liquor has been recovered from the house where the vehicle was parked. He submits that the petitioner has no criminal antecedent which is disclosed in para 12 of the petition. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that petitioner was owner of the vehicle in question.

Considering that the vehicle in question was sold by the brother

of the petitioner to one Md. Mahatab Alam and said Md. Mahtab Alam sold the said vehicle to one Abhinash Kumar in view of that the name of the petitioner has come, the petitioner has no criminal antecedent which is disclosed in para 12 of the petition, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named, petitioner is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned learned Judicial Magistrate, IX, Ranchi, in connection with Namkum P.S. Case No. 191/2020, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
