Supplementary affidavit, filed today, is taken on record. It is contended that both the petitioner and respondent were married according to Muslim rites and customs on 16.11.2020. As matrimonial dispute had arisen between the parties, the petitioner was thrown out of the matrimonial house. A petition for restitution of conjugal rights was moved by the respondent on 28.7.2021 before the Principal Judge, Family Court, Siddharthnagar, which has been registered as Matrimonial Case No.309 of 2021 (Junaid vs. Kulsum) which is pending consideration. The sole prayer made in the writ petition is for expeditious disposal of the said petition. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon Principal Judge, Family Court, Siddharthnagar to decide Matrimonial Case No.309 of 2021 (Junaid vs. Kulsum), in accordance with law, after hearing all affected parties, preferably within a period of six months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
