1. Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. 2. This application, for grant of anticipatory bail, arises out of Muffasil Police Station Case No. 07 of 2025, dated 03.01.2025, disclosing offences under Sections 30(a) of
Patna High Court CR. MISC. No.15144 of 2025(2) dt.09-04-2025 2/3 the Bihar Prohibition and Excise Act
3. The prosecution case, as per the First Information Report, is that on 03.01.2025, the police, while on patrolling got secret information that the petitioners were indulged in preparation of country-made illicit liquor near Sohepur Badhaar near Neemhar Ahar Pul, reached at the place of occurrence and saw that three persons started fleeing away and succeeded in it. Upon search, the police recovered 400 liters of country made illicit liquor, two burning bhatti (furnace) and 30 drums of fermented mahua, which was destroyed at the site, from the spot. 4. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in the present case on mere suspicion and on the basis of village politics.
He next submits that the petitioners were not present at the place of occurrence and neither illicit liquor nor any incriminating articles has been recovered from conscious possession of the petitioners and/or premises belonging to them. 5. Having regard to the submissions made on behalf of the parties and taking into consideration the allegation that petitioners were involved in manufacturing of spurious
