For Petitioner(s): T.DHARANI SARATH KUMAR M REEGAN UJAKAR A For Respondent(s): Mr.U.Baranidharan, Special Government Pleader ORDER This writ petition has been filed for the issue of writ of Mandamus directing the respondents 1 to 4 to cancel the fraudulent document created by respondents 5 to 6 based on the representation made by the petitioner on 14.10.2024. https://www.mhc.tn.gov.in/judis WP No. 6174 of 2025 2. Heard Mr.T.Dharani, learned counsel for the petitioner and Mr.U.Baranidharan, learned Special Government Pleader for respondents. 3. In the considered view of this Court, the power for cancellation of the registered document was available under Section 77A of the Registration Act. This provision has been now struck down by the Division Bench of this Court as unconstitutional in [M. Kathirvel Vs. The Inspector General of Registration Department of Registration and Others] reported in 2024 4 CTC 769. Hence, as on today, the registration department does not have any power to cancel the document. Therefore, if the petitioner has any grievance, it can only be worked out before the competent Civil Court in accordance with law. Except giving this liberty, no further orders can be passed in this writ petition. 4. This writ petition is disposed of in the above terms.
