JUSTICE SHAILENDRA SINGH ORAL ORDER 2 16-09-2025 The instant writ petition has been filed by the petitioner under Article 226 of the Constitution of India seeking the following reliefs:- “A) To remove encroachinent over the land of the petitioner which has been encroached by making Nala and soling bricks over the raiyati land of petitioner vide khata No. 339 plot No. 635, Area 6 decimals situated at mauza Kurthaur, District Patna. (B) To pay compensation to the petitioner for changing the physical structure of the raiyati land of petitioner by way of making Nala and brick soling after filling the soil without any acquisition under land acquisition act. The said construction made under Rural Development Scheme (Gali Nali Yojna). (C) To grant any other relief or reliefs for which the petitioner is found entitle due to less suffered by him”. 2. Heard Mr. Anil Kumar No.1, learned counsel for Patna High Court CWJC No.7833 of 2021(2) dt.16-09-2025 2/2 the petitioner and Mr. Sanjay Prasad, learned AC to AAG-4 for the State-respondents. 3. The main grievance of the petitioner is that upon his purchased land a Nala has been constructed in the year 2021 without acquiring his land and giving compensation to him. The petitioner is a teacher by profession and for redressal of his grievance he has filed an application before the District Magistrate, Patna (Annexure-3) and thereafter before the Deputy Development Commissioner, Patna (Annexure-4) but no action has been taken till date. 4. Considering the nature of the prayer, this court is not persuaded to invoke the writ jurisdiction of this court to redress the petitioner’s grievance, however, the District Magistrate, Patna is directed to look into the matter and take necessary steps to redress the petitioner’s grievance if he has made out a bonafide case at the earliest, preferably, within a period of six weeks from the date of receipt/ production of a copy of this order. 5.
