Page No.# 2/3 of bail to the accused/applicant, viz., Sri Ashim Gogoi in connection with Dhemaji P.S. Case No.165/2025 registered under Sections 21(b)/29 of the NDPS Act. The gist of the allegation against the accused/applicant as narrated in the F.I.R. dated 03.10.2025 is that on receipt of certain confidential information police apprehended the accused person and recovered 55.89 gms of suspected heroin from his possession. On receipt of the F.I.R., Dhemaji P.S. Case No.165/2025 was registered under the aforementioned sections of law. The accused was arrested on the very same day i.e. 04.10.2025 and since then for the last 60 days he is behind the bars. The learned counsel for the accused/applicant submits that since the accused/applicant has already spent 60 days in jail and the investigation has not yet been completed, he is eligible for default bail. The learned Additional Public Prosecutor also submits that the accused/applicant has already spent 60 days behind the bars and charge-sheet in the instant case is yet to be filed. In view of the aforesaid, this Court is of the view that the accused/applicant is eligible to be granted default bail in the instant case and accordingly it is directed that the accused/applicant shall be released forthwith on furnishing a bail bond of Rs.30,000/- with a surety of like nature to the satisfaction of the learned Special Judge (NDPS),
Page No.# 3/3 Dhemaji subject to the following conditions :- (1) That the accused/applicant shall regularly appear during the trial, if one commences and shall not try to influence or intimidate the witnesses in any manner; (2) That the accused/applicant shall not commit any offence while on bail.
