GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the action of the 3rd Respondent in issuing proceedings dated 18.11.2012 in C.No.129/ACP EZ/2012 opening the suspect sheet against the petitioner continuing the same though no crime is pending as illegal, arbitrary, contrary to the Police Standing Orders and violation of fundamental rights guaranteed under Article 14 and 21 of the Constitution of India and Consequently 2 direct the respondents to forthwith remove the Petitioners name from Rowdy/Suspect sheet pending with the 4th respondent.” 2. Sri Md.Farooq, learned Assistant Government Pleader for Home would submit that there are no cases pending against the Petitioner and to curb and curtail the unlawful activities of the Petitioner in the vicinity, Rowdy Sheet vide proceedings dated 18.11.2012 in C.No.129/ACP/EZ/2012 has been opened against the Petitioner. 3. Sri B.V.Anjaneyulu, learned counsel for the Petitioner would submit that, no cases are pending against the Petitioner and hence, the rowdy sheet opened against the Petitioner may be closed. 4. Considering the submissions made, the Writ Petition is allowed and the impugned Rowdy Sheet vide proceedings dated 18.11.2012 in C.No.129/ACP/EZ/2012 against the Petitioner is hereby set aside. There shall be no order as to costs.
