Order on Board Per Ramesh Sinha, Chief Justice 16.06.2025
1. None appears for the petitioners to press this petition on the repeated calls. Heard Mr. Malay Jain, learned Panel Lawyer, appearing for the State / respondent Nos. 1 and Mr. Aman ROHIT KUMAR CHANDRA Digitally signed by ROHIT KUMAR CHANDRA
2 Tamboli, learned counsel, appearing for respondent No.2. 2. The present petition has been filed by the petitioners under Section 482 of the Code of Criminal Procedure, 1973 with the following prayers :-
“That, this Hon’ble Court may kindly be allow the petition and quash the FIR No. 327/2023 registered by the respondent No.1 against the petitioners, in the interest of justice.”
3. There appears to be an application i.e. I.A. No. 03 of 2023 for deletion of name of petitioner No.1 Laxmi Bai Sharma @ Lalee Bai on the ground that during investigation concern police station has not found any evidence against petitioner no.1, and no charge-sheet has been filed against her, therefore, the name of petitioner No.1 be deleted from the array of cause-title. 4. On due consideration, I.A. No. 03 of 2023 stands allowed. Let the name of petitioner No.1 be deleted from the array of cause-title. 5.
So far petition with regard to other petitioners is concerned from perusal of the record, there appears to be no interim order has been passed in the instant case and learned counsel for the private respondent No.2 submitted that charge-sheet has filed and charges have been framed against the petitioners. 6. In view of the same and further considering the fact that none appears for the petitioners to press this petition on the repeated calls, it seems that the petitioners have lost interest in pursing the matter. 3
7. Accordingly, the instant petition stands dismissed. 8. Interim order, if any, stands vacated. 9. The trial Court is directed to proceed with the trial, if already not proceeded. Sd/- Sd/- (Bibhu Datta Guru)
