02/25.09.2025 Heard Ms. Tanu Kumari, learned counsel for the petitioner and learned Spl.P.P.
The prayer for anticipatory bail of the petitioner was earlier rejected on 14.07.2023 in A.B.A. No.4875 of 2023.
Submission has been advanced by learned counsel for the petitioner that the petitioner has already been acquitted in Cyber Case No.08 of 2019 vide judgment dated 05.03.2025 passed by learned Special Judge Cyber Crime, Jamtara. Learned counsel further submits that the implication of the petitioner seems to be on account of the confessional statements of co-accused Dilip Mandal and there is no other incriminating material which would suggest about the involvement of the petitioner in cyber crime.
Learned Spl.P.P has opposed the prayer for anticipatory bail of the petitioner.
It appears that the basis for rejecting the prayer for anticipatory bail of the petitioner has evaporated on account of his acquittal in a criminal case which has been noted above. There does not seem to be any other material, save and except the confessional statement of Dilip Mandal to implicate the petitioner.
Regard being had to the above, I am inclined to extend the privilege of anticipatory bail to the petitioner. Accordingly, he is
directed to surrender before the learned court below within a period of four weeks and on his surrender, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten
2
Thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge Cyber Crime, Jamtara in connection with Jamtara Cyber Crime P.S. Case No.42 of 2022, subject to the conditions as laid down under Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita, 2023.
