The petitioner is apprehending his arrest in connection with Ahilyapur PS Case No.38 of 2023, for offence registered under section 411, 413, 414, 419, 420, 467, 468, 471, 120B/34 IPC and Sections 66(B), 66(C), 66(D) of Information Technology Act, pending in court of learned Additional Sessions Judge II cum Special Judge (Cyber Crime), Giridih. 3. Learned counsel for petitioner submits that petitioner has moved before this Court in A.B.A. No.4735 of 2024 which was dismissed as withdrawn. He further submits that the petitioner has filed the Cr.M.P. No.2521 of 2025. He then submits that process under section 82 CrPC has been issued and the same order was quashed in Cr.MP No.2521 of 2025 by Coordinate Bench of this Court by order dated 4.9.2025 and in view of that the present ABA has been filed. 4. Learned State counsel submits that if the petition was earlier withdrawn simply without any liberty and if any changed circumstance is there, the petitioner is required to move before the learned court of Sessions Judge. 5. At this stage, Mr. R.S. Mazumdar, the learned Senior counsel appearing on behalf of the petitioner on instruction by the assisting counsel seeks permission to withdraw the instant application with liberty to move before the learned Sessions Judge. 6. Learned counsel for the respondent State has got no objection for the same. 7. This petition is dismissed as withdrawn with the aforesaid liberty. ( Sanjay Kumar Dwivedi, J.)
