SHIVA REDDY, AGA) THIS WP IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA, PRAYING TO QUASH THE INVESTIGATING REPORT SUBMITTED BY THE R-2 VIDE ANNEXURE-N TO THE WP AND ETC. THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE N S SANJAY GOWDA - 3 - NC: 2025:KHC:17371 WP No. 12253 of 2025 ORAL ORDER 1. This petition is filed challenging an enquiry that has been initiated to the petitioners in exercise of his powers under Section 108K of the Karnataka Land Revenue Rules. 2. It is the case of the petitioners that this enquiry has been initiated on the basis of an inspection report dated 21.02.2025 and this enquiry report is untenable. 3. It is also contended that the Assistant Commissioner himself has held on more than one occasion that the grants made in favour of the petitioners was genuine and, therefore, there cannot be a scope for one more enquiry. 4. In my view, this contention can be very well raised before the Assistant Commissioner, who had issued a notice to the petitioners and, obviously, if such a contention is raised, the Assistant Commissioner - 4 - NC: 2025:KHC:17371 WP No. 12253 of 2025 would consider the same and also taken into consideration the order that he has passed earlier before passing any order in the enquiry that is now initiated. 5. Subject to the above, this writ petition is dismissed. 6. In view of the disposal of the petition, all pending interlocutory applications, if any, stand disposed of.
