1. The petitioner has filed the instant petition under Section 226 of the Constitution of India seeking following reliefs:

“10.1. That this Hon'ble court kindly be pleased to allow the writ petition filed by the petitioner and not to proceed to evict the land and the dwelling house of the petitioner of the plot No. 9 arising out of khasra no. 557/1 of Chantidih PH No. 109 Bilaspur, District Bilaspur, Chhattisgarh and also to direct to respondent to maintained the status quo pending the disposal writ petition filed by the petitioner. 10.2 Any other relief, which this Hon'ble Court may deem fit and proper, may also be passed in favour of the petitioner.”
2. Mr. Agrawal, learned counsel for the respondent-Municipal Corporation submits that till date demarcation has not been done in the dwelling house of the petitioner. He further contended that this writ petition may be disposed of with a direction to the concerned respondent-authority to demarcate the dwelling house/property in question and if it is found that the petitioner has encroached the Government land then proceed in accordance with the law.
3. Learned counsel for the petitioner has not objected the above submission of counsel for the respondent-Corporation.
4. Considering facts of the case, above submissions of counsel for the parties, the instant writ petition is disposed of at this stage directing the concerned respondent-authority to demarcate the dwelling house/property in question and if it is found that petitioner has encroached the Government land then proceed in accordance with the law. CC as per rules.
