JUSTICE ANOOP KUMAR DHAND Order 22/07/2025
1. Counsel submits that an eviction application under Section 9 of the Rajasthan Rent Control Act, 2001 (for short, ‘the Act of 2001’) was submitted by the petitioner against the respondents before the Rent Tribunal in the year 2017 and during pendency of the said application, another application under Section 19-A of the Act of 2001 was submitted by the petitioner in the month of March, 2024, thereafter, the case was posted for reply of the respondents, but in-spite of availing several opportunities, no reply was filed, hence, on 22.08.2024, ex-parte proceedings were initiated against the
(2 of 2) [CW-10771/2025] petitioner and the case was posted for arguments on the said application on 14.10.2024.
2. Counsel for the petitioner submits that no application has been submitted by the respondent for setting aside the aforesaid order dated 22.08.2024 initiating ex-parte proceedings, even then, the application submitted by the petitioner under Section 19-A of the Act of 2001 has been posted from one date to another i.e. on 15.10.2024, 02.12.2024, 13.01.2025, 28.02.2025, 24.03.2025 and 25.04.2025, but the same has not been decided.
3. It is expected from the Rent Tribunal to decide the pending application expeditiously, instead of keeping the same pending for indefinite time by posting the matter from one date to another.
4. Considering the above factual aspect of the matter, the instant writ petition stands disposed of with the expectation from the Rent Tribunal to decide the application filed by the petitioner under Section 19-A of the Act of 2001, expeditiously as early as possible, preferably within a period of three months from the date of receipt of certified copy of this order.
5. Pending applications, if any, also stand disposed of.
