JUSTICE AMBUJ NATH ----- For the Petitioner : Mr. Ashok Kumar, Advocate For the State : Mr. Sardhu Mahto, A.P.P. --- 03/12.02.2025 Heard the parties. Petitioner has been made accused in connection with Netarhat P.S. Case No.01 of 2023, corresponding to G.R. Case No.214 of 2013 and S.T. Case No.154 of 2023 for the offences registered under Sections 302, 325, 506, 34 of the I.P.C. and charge has been framed under Sections 302/34, 325/34, 506/34 of the I.P.C., pending in the Court of learned Sessions Judge, Latehar. On 22.01.2023 at about 1:00 noon, the petitioner along with co- accused Binod Brijiya are alleged to have assaulted the husband of the informant by lathi due to which, he succumbed to his injuries. Learned counsel for the petitioner submitted that co-accused Binod Brijiya has been granted bail by a Co-ordinate Bench of this Court. Learned A.P.P. has opposed the prayer for bail and submitted that there is direct allegation against the petitioner that he had assaulted the deceased due to which, he succumbed to his injuries. Considering the nature of allegation, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail stands rejected. (Ambuj Nath, J.) Jay/-
