Case No.20/2015, corresponding to G.R. No.436/2015, including the order dated 16.11.2018 passed by the learned Additional Chief Judicial Magistrate, Gumla, whereby and wherein, learned Additional Chief Judicial Magistrate, Gumla has been pleased to take cognizance of the offences under Sections 419, 420, 467, 468, 471 & 120B of the Indian Penal Code and also for quashing of the order dated 29.05.2019 passed by the learned Additional Chief Judicial Magistrate, Gumla, whereby and wherein, the petition filed on behalf of the petitioner for review of the order taking cognizance dated 16.11.2018 has been rejected. 2. The case of the opposite party No.2 is that the land in question belonged to her mother-in-law Jatri Devi. Co-accused persons by producing a fictitious lady impersonating to be her mother-in-law got the said land transferred to the present petitioner by a registered sale deed. 3. The police after investigation found the occurrence to be true and submitted the chargesheet against the accused persons. 4. It appears that subsequent to filing of this case, the petitioner filed a case against Ritesh Kumar Gupta, Anuj Tete, Malti Devi and Salko Devi with regard to the same occurrence, being Chainpur P.S. Case No.27/15, for the offences under Sections 420, 406, 467, 468, 471 & 120(B)/34 of the Indian Penal Code, stating that the accused persons by misrepresenting -2- induced him to purchase a land belonging to Jatri Devi by producing a fictitious person Salko Devi at the time of registration of the sale deed. He has claimed that he was a bonafide purchaser and the victim of circumstances. 5. It appears that after investigation, the police found the occurrence to be true and submitted chargesheet in connection with Chainpur P.S. Case No.27/15 against the accused Anuj Tete, Malti Devi and Ritesh Kumar Gupta. The petitioner Rakesh Ranjan @ Munna @ Jhunna has been made a witness in this case. 6. From the entire facts and circumstances, it is apparent that the police has found during investigation of Chainpur P.S. Case No.27/15 that the present petitioner Rakesh Ranjan @ Munna @ Jhunna was a bonafide purchaser and he was also duped by the accused persons, just as the informant Meena Devi of the present case. 7. In view of the aforesaid facts, the entire criminal proceedings alongwith the consequent order of Chainpur P.S.Case No.20/2015, corresponding to G.R. No.436/2015, qua this petitioner is quashed. 8. Accordingly, this criminal miscellaneous petition is allowed. Pending I.A., if any, also stands disposed of. (Ambuj Nath, J.) BS/-
