ORDER 03.12.2025 Heard Mr.S.C. Biswas, learned counsel for the petitioner. Also Heard Mr.R.J. Baruah, learned Addl Public Prosecutor for the State.
2. This is an application under Section 483 of the BNSS, 2023 for granting of
Page No.# 2/3 regular bail to the petitioner, namely, Deep Roy in connection with Dispur PS Case No. 886/2025 under Section 316(2) of BNS, 2023.
3. It appears that this Court had granted bail to the petitioner by Order dated 26.11.2025 in Bail Application No. 3799/2025 in connection with another case i.e. Dispur PS Case No. 639/2025. But in the present case, i.e. Dispur PS Case No. 886/2025, he has been shown arrested in the present case on 06.11.2025.
4. As per the FIR lodged by one Biju Gaonkhuwa on 12.09.2025, his vehicle bearing registration No. AS01 GE 2419 had been stolen. It has been stated in the bail objection submitted by the I.O that during the preliminary investigation, SI Biswajit Debnath of Dispur PS found that one Mr. Debajit Bhattacharyya made an agreement and fraudulently taken away the Vehicle Maruti EECO 5 Star AC(O) bearing Registration No-AS 01GE2419, chassis no-MA3JDT08WRID75971, Engine no- K12NN4310824. Year mfg. 09/2024. colour-Glistening Grey. On 15/03/2025 the accused came to his current Residence Name- "SWARAJ Residency, Hangrabari and approached him under the pretext of providing various work opportunities. Debajit Bhattacharyya offered the complainant that one vehicle is urgent need on monthly rent for school purpose and he has promised to Biju Gaonkhuwa a payment of a total amount of Rs. 30,000/ thousand only per month. After that day the accused did not respond to the calls of the complainant. Accordingly, a case has been registered at Dispur PS vide case No- 886/2025, U/S-316(2) of BNS, 2023.
5. During investigation, it is found that a huge nexus of fraud and cheating is going on where a group of accused ensnared different victims in their trap to give their vehicles on monthly rent basis or on self drive purpose. But for their
Page No.# 3/3 wrongful gain the accused illegally sold those vehicles at Manipur and Nagaland. In the current case the vehicle was taken by Debajit Bhattacharyya along with Deep Roy and company. Present accused Deep Roy had driven the vehicle from Guwahati to Hojai and then sold it for 2.5 Lakh rupees at Manipur.

Learned counsel for the petitioner, Mr. S.C. Biswas submits that there is dichotomy between what has been stated by the I.O and what is contained in the FIR and that the Police has been wilfully implicating the accused petitioner on the basis of an FIR containing completely different allegation without naming the present petitioner by registering the present case almost one and a half months later.
7. Learned Addl. Public Prosecutor submits that the petitioner is a habitual offender and is involved in several similar cases and multiple FIRs had been lodged against him regarding illegal sale of rented vehicles and if he is released on bail, he will continue with the aforesaid activities.
8. Upon perusal of the Case Diary, I find sufficient incriminating material against the accused/petitioner. Considering the same, the prayer for bail stands rejected.
9. Accordingly, the Bail Application stands dismissed.
