02/24.09.2025 Heard learned counsel appearing for the petitioners and learned counsel appearing for the State.
2. The petitioners are apprehending their arrest in connection with Sonahatu P.S. Case No.19 of 2025, registered for the offences under Sections 303(2)/317(5)/3(5) of the Bharatiya Nyaya Sanhita, 2023, Section 13 of Jharkhand Mineral Prevention of Illegal Mining Transportation and Storage Rules, 2017 and Section 54 of JMMC Rule and Section 21 of MMDR Act, 1957 pending in the Court of the learned JMFC at Ranchi.

Learned counsel appearing for the petitioners submits that the 4000CFT sand was alleged and to be stored on the particular land and the petitioners have nothing to do stored sand and the land also not belongs to the petitioners. He then submits that the name of the petitioners have been disclosed by the villagers. He also submits that the petitioners have no criminal antecedents.

Learned counsel appearing for the State opposed the prayer and submits that the allegations leveled against him is that the 4000CFT sand is stored on a particular land.
5. Considering that petitioners have no criminal antecedents and even the land and sand of the petitioner has been denied and in the attending
facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioners.

Accordingly, the above-named petitioners are directed to surrender before the learned Court within three weeks from today and in the event of their arrest or surrender, they will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned JMFC at Ranchi in connection with Sonahatu P.S. Case No. 19 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
