Page No.# 2/3 of pre-arrest bail to the accused-applicant in connection with Vigilance P.S. Case No. 01/2024, registered under Sections 120B/420/468/471/406/409 of the IPC, read with Section 13(1)(a)/13(2) of PC Act, 1988. 3. The gist of the allegation against the accused-applicant as narrated in the FIR is mainly with regard to the preparation of final bill of the contract involved in the execution of PMGSY package No. AS-13-261, pertaining to construction of road, namely “Anipur NEC road at Harinagar to PuboBaruala”, along with construction of 2 nos. of RCC bridges, in which bills were passed for payment. 4. The Case Diary, as called for, is placed before the Court. 5. It may be relevant to mention herein that vide the order dated 07.11.2025, Co- ordinate Benches of this Court, had granted the privilege of interim pre-arrest bail to the co-accused namely, Sahidur Rahman Laskar and Md. Mohosin Ahmed Laskar on 07.11.2025 and 24.10.2025 respectively. The aforesaid two pre-arrest bail application being AB No. 2627/2025 and AB No. 2507/2025 respectively, were listed before this Court today for further consideration. 6. After perusing the Case Diary, this Court vide order dated 10.07.2025 has made the interim pre-arrest bail in respect of both the Anticipatory Bail Applications absolute. 7. In view of the aforesaid orders passed by this Court in the aforesaid two (2) Anticipatory Bail Applications and on perusal of the Case Diary regarding the materials involved in the instant case, this Court is of the opinion that in the instant case also, the accused-applicant should be granted the privilege of pre-arrest bail on furnishing a bail- bond of Rs. 30,000/- (Thirty Thousand) with a suitable surety of like amount to the satisfaction of the arresting authority, subject to the following conditions: - (i) the accused-applicant shall appear before the Investigating Officer within a period of 10 days of passing of this order and shall co-operate with the investigation.
Page No.# 3/3 (ii) the accused-applicant shall not, directly or indirectly, make any attempt to influence witnesses or tamper with evidence or induce any person acquainted with the facts of the case to dissuade them from disclosing such facts to the police of the Court. 8. In view of the aforesaid directions, the instant Anticipatory Bail Application is
disposed of as allowed.
