ORAL ORDER
Accused Nos.3 and 4 in Crime No.256/2025 registered by North CEN Crime Police Station, Bengaluru City for the offence punishable under Sections 318(4) of BNS, 2023 & Section 66(C) & 66(D) of the Information Technology Act, 2000 are before this Court under Section 482 of BNSS, 2023 seeking anticipatory bail.
2. Heard the learned counsel appearing for the parties.

FIR in Crime No.256/2025 was registered by North CEN Crime Police Station, Bengaluru City against one Balaram Yadav and three others for the aforesaid offences on the basis of first information dated 21.03.2025 received from Sri Darshan M.S S/o Sriram M G, authorized representative of Reliance General Insurance Co., Ltd.,. Apprehending arrest in the said case, the petitioners had filed Crl.Misc.No.2855/2025, which was rejected on 07.04.2025. Therefore, they are before this Court.

Learned counsel for the petitioners submits that the petitioners are the sister and wife of accused No.1 - Balaram

Yadav. Accused No.1 had voluntarily surrendered before the police in the present case and he was subsequently enlarged on bail by the jurisdictional Court of Magistrate.
5. The material available on record would go to show that, entire allegation is as against accused No.1, who was arrested in the present case. The amount was transferred to the account of the petitioners at the instance of accused No.1 and the petitioners were not aware of the alleged fraud committed by accused No.1. They are ready and willing to cooperate with the police for the purpose of investigation. Accordingly, he prays to allow the petition.
6. Per contra, learned HCGP, who has opposed the petition submits that the petitioners hail from Uttar Pradesh state and considering the nature of allegation, their custodial interrogation is required. Accordingly, she prays to dismiss the petition.
7. In the first information it is stated that accused No.1 - Balaram Yadav was an ex-employee of BEACON Insurance Brokers Pvt. Ltd., and he had collected information of the policy holders of Reliance General Insurance Company Ltd., and thereafter based on fraudulent concocted documents he

had managed to get reimbursement of the policy holders, which was transferred to his account and also to the account of accused Nos.3 and 4. Accused Nos.3 and 4 are the sister and wife of accused No.1. Accused No.1 appears to have surrendered before the police on 27.03.2025. Subsequently, he was remanded to judicial custody.

Learned counsel for the petitioners has produced material before this Court which would go to show that, jurisdictional Court of Magistrate has enlarged accused No.1 on bail in the present case. The alleged offences are triable by the Court of Magistrate and maximum punishment for the alleged offences is imprisonment for a period of seven years. Accused No.1 during the course of his interrogation has stated before the police that he had made false claims based on the fraudulent documents and it is at his instance claim amount was transferred to the account of his sister and wife. The petitioners, who are ladies having no criminal antecedents have undertaken to cooperate with the police for the purpose of investigation. Under these circumstances, I am of the opinion that, the petitioners' prayer for grant of anticipatory bail is required to be answered affirmatively.

9. Accordingly, the following:
ORDER The Criminal Petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioners in the event of their arrest in Crime No.256/2025 registered by North CEN Crime Police Station, Bengaluru City for the offence punishable under Sections 318(4) of BNS, 2023 & Section 66(C) & 66(D) of the Information Technology Act, 2000 subject to the following conditions:
1. The petitioners shall appear before the Investigating Officer in the present case within fifteen days from the date of this order on executing a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) each with one surety for the likesum to the satisfaction of the investigating officer/jurisdictional Court.
2. The petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons.
3. The petitioners shall not tamper with the prosecution witness and they shall co-operate

with the Police for investigation and appear before them whenever called upon.
4. The petitioners shall not involve in similar offences in future.
