Heard the parties.
The petitioner has been made accused in connection with Latehar P.S. Case No. 104 of 2023, for the offences registered under Sections 385, 386 & 387/34 of the Indian Penal Code and Sections 25(1-A), 26 & 35 of the Arms Act, pending in the court of learned C.J.M., Latehar.
On 16.05.2023 at about 1:00 A.M, the informant party received confidential information that 8 to 9 unknown persons had come to Tube Coal Mines for extorting levy from the owner. The police party raided the place of occurrence and apprehended five persons.
It was submitted that petitioner was not apprehended at the spot and his name has come in the confession of co-accused persons. It was further submitted that named accused persons who were apprehended at the place of occurrence, have been granted bail by the Coordinate Bench of this Court as well as by this Court.
Mr. Sudhir Kumar Mahto, learned A.P.P on behalf of the State has opposed the prayer for bail.
In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned C.J.M., Latehar, in connection with Latehar P.S. Case No. 104 of
2023.
