2. The above writ petition is filed to declare the. action of respondent No.3 in threatening to dispossess the petitioner from Ac.2-00 of land in survey No.667/3 of Venkatachalam Village and Mandal, S.P.S.R. Nellore District, without following due process of law, as illegal and arbitrary.
Learned counsel for the petitioner would submit that the petitioner purchased Ac.2-00 of land in survey No.667/3, in Venkatachalam Village and Mandal, S.P.S.R. Nellore District, from one Junju Adaiah, S/o Pothaiah, under an unregistered possessory agreement of sale dated 29.09.2018, and the petitioner has been in possession and enjoyment of the subject property. 3. Page 3 of 5 SRSJ W.P.No.17766 of 2025 r would further submit that respondent No.3, without issuing any notice, is threatening to dispossess the petitioner from the subject property. Hence, the writ petition. 4. Learned Assistant Government Pleader for Revenue submitted the instructions furnished by Tahsildar, respondent No.3, Vide Rc.B.508/2025 dated 14.07.2025 and submitted that respondent No.3 is not interfering with the land in survey No.667/3. A perusal of the instructions furnished by respondent No.3 would disclose that as per RSR of Kanupur Bit-I village, Venkatachalam Satram, Trustee Mallavarapu Subba Rao was assigned the land of an extent of Ac.74.80 cents in survey No.667/3 vide patta No. 1106, and he is the pattadar. The instructions further disclose that the Deputy Commissioner, Endowments, Guntur, vide Rc.No.6618/2007, B1 dated 02.08.2007, authorised the Assistant Commissioner, Endowments, Nellore, to remove the encroachments from the land of an extent of Ac.60-00 cents in survey Nos.650 to 671 situated at Venkatachalam village. While conducting a re-survey, it was noticed that the land of an extent of Ac.74.80 cents in survey No.667/3 correlates with LPM No. 1716 and it is included in the list of prohibited property under Section 22(A) (1) (C) of the Registration Act, 1908. The instructions further disclose that the land is with the Endowments Department and not with the Revenue Department. 5. 7. The instructions furnished by the Tahsildar are recorded. Thus, the grievance of the petitioner that respondent No.3 is interfering with the subject land is misconceived. The instructions demonstrate that respondent No.3 has nothing to do with the property in survey No.667/3. 8. 9. Given the instructions and submission of learned Assistant Government I Pleader for Revenue, this writ petition is disposed of at the admission stage. Page 4 of 5 SR. W.P.No.17766 of 2025 with the consent of learned counsel on either side, directing respondent No.3 not to interfere with the land in survey No.667/3 of Venkatachalam Village and Mandal, S.P.S.R. Nellore District, without following due process of law. No costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
