P.P. ---- 2/15.09.2025 Heard learned counsels for petitioner and for State. 2. The petitioner is apprehending his arrest in connection with Hunterganj P.S. Case No.38 of 2023, for offence registered under section 272, 273, 284, 290, 414/ 34 of IPC and section 47 of Excise Act, pending in court of learned Judicial Magistrate, First Class, Chatra. 3. Learned counsel for petitioner submits that the alleged liquor has been recovered from the vehicle (Tempo) and that was recovered on 2.3.2023. He submits that the said vehicle was purchased by the petitioner on agreement for dismantling of the same as the petitioner is the proprietor of Maa Mundeshwari Agency, Barachati and that Agency is dealing in scrap articles. 4. Learned State counsel opposes prayer and submits that from said vehicle (Tempo) in question liquor has been recovered. 5. Considering that the petitioner happened to be the proprietor of Maa Mundeshwari Agency, Barachati and that Agency deals in scrap articles and it has been pointed out that the said vehicle has been purchased by the petitioner on agreement for scrapping the said Tempo, I am inclined to grant anticipatory bail to petitioner. 6. Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Judicial Magistrate, First Class, Chatra, in connection with Hunterganj P.S. Case No.38 of 2023, subject to conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023. ( Sanjay Kumar Dwivedi, J.) 15th Sept., 2025/ SI-
