cran3577.24 -1- IN THE HIGH COURT OF JUDICATURE AT BOMBAY BENCH AT AURANGABAD 1 CRIMINAL APPLICATION NO. 3577 OF 2024 Khandu @ Khanderao Ramrao Patil VERSUS The State of Maharashtra and another ... Advocate for Applicant : Mrs. Sabahat T. Kazi APP for Respondent No.1: Mr. P.S. Patil ….. CORAM : SMT. VIBHA KANKANWADI AND SANJAY A. DESHMUKH, JJ. DATED : 25th JULY, 2025 PER COURT :- 1. The present application has been filed for quashment of the F.I.R. vide C.R. No. 20 of 2024 registered with Parola police station, district Jalgaon, for the offences punishable under sections 436, 336, 286, 285, 278, 188, 379, 139, 34 of I.P.C. and under Section 3 and 7 of Essential Commodities Act, 1955. 2. Learned advocate for the applicant has taken us through the contents of the F.I.R. which has been filed by the present respondent No.2, who is Supply Inspector. He submits that after he was informed by Tahsildar Parola, he had gone to the spot and it was seen that some gas cylinder which was kept unauthorizedly had exploded. The said explosion has caused damage to two Omni vehicles and several other articles nearby. Further, there were 9 2025:BHC-AUG:19844-DB cran3577.24 -2- exploded gas cylinders and 12 were intact. However, in the F.I.R. it is stated that, from the discussion of the people who had gathered at the spot, he came to know that the said storage of the gas cylinders is at the behest of present applicant. Learned advocate for the applicant submits that the said information is hearsay and thereby the applicant need not be asked to face further investigation and the trial. 3. Here, it is to be noted that F.I.R. is not an encyclopedia. The investigation is going on. The police would come to the conclusion as to who was the owner and at whose behest the gas cylinder was there and how much the quantity were stored without taking precaution. Certainly, there appears to be huge explosion and it appears that fortunately there is no casualty. Under such circumstances, we do not want to abort the investigation. No case is made out for quashment of the F.I.R. The application stands rejected at the threshold. (SANJAY A. DESHMUKH, J.) (SMT. VIBHA KANKANWADI, J.) rlj/
