ORDER: The Criminal Petition has been filed under Sections 437 and 439 of the code of criminal procedure, 1973 (for brevity fthe Cr.P.C.I)/ sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity [the BNSS'), seeking to enlarge the Pet-ltiOner/Accused No.2 on bail in Cr.No.479 of 2024 of Bhimunipatnam Police Station, visakhapatnam commissionerate, registered against the petitioner/Accused No.2 herein for the offenCeS Punishable under sections 109 (1),118 (1), 74 read with 3 (5) of the Bharatiya Nyaya sanhita, 2023 (for brevity [the BNS'). 2. The case of the prosecution iS that On 28-ll-2024 at about 20:30 hours, the complainant stated that he had a Past dispute With Accused No.2, who assaulted him On multiple occasions. On the day of the incident, after returning from work, the compla-lnant was confronted by A-2 and Arajala Ajay, during which A-2 slapped him, leading to a scuffle. Ajay then hit him on the head With a beer bottle, Causing bleed-lng, and attempted to stab him with the broken bottle. As the complainant fled home and boarded an auto w'lth his family to reach the hospital, A-2, Ajay, and Pandu stopped the auto, dragged him out, and beat him with / ++ i:. 3 Dr. YLR, J Crl.P.No.7260 of 2025 Dclted 24.07.2025 an iron rod. When his uncle Piradi Ramarao tried to intervene, Ajay hit him with a wooden billet and bricks, causing a head injury. His mother Nookalamma and father Gurumurfhy were also assaulted, and his father was stabbed in the back with a broken bottle. police were called via Dial 112, and the injured were shifted to Bheemili Government Hospital. Hence, a case was registered against the pet-ltioner/Accused.No.2. 3. Sri J.Ravi Kumar, the learned counsel for the petitioner, submits that the petitioner has not committed any offence; he is falsely implicated in this case; he is sole breadwinner of his family; he is ready to abide any conditions to be imposed by this Court; and urged to enlarge the petitioner on bail. 4. Per confra, Ms.P.Akila Nai'du, the learned Assistant Public Prosecutor, opposed in granting of bail stating that some more material witnesses have to be examined; investigation is not completed; if the petitioner is enlarged on bail, he would not be available for the investigation and he would escape from the clutches of law; and it is urged to dismiss the bail application. 5. 6. As seen from the record, the injured suffer sI'mPle injuries aS Per the wound certificate. The petitioner/Accused No.2 was arrested on 03.06.2025 and ever since he has been in the judicial custody for the Past 52 days. ln this case, Accused Nos.1 and 3 were already enlarged on bail by the learned Trial Court. 7. Keeping into consideration the nature of allega{I'OnS levelled against hI`m, hl'S alleged role played in this case and the period of detention undergone by him in the judicl®al custody, this court is inclined {o, enlarge the petitI|Oner On bail With Certain Stringent conditions. 8. In the result, the Criminal Petition is allowed with the following conditI'OnS: I-. The petitioner/Accused No.2 shall be enlarged on bail subject to he executing a personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties for the like sum each to the satisfaction of the learned XV AddI'tiOnaI Judicial First CIass Magistrate at BheemunI`Patnam. ii.
